What Information Do We Collect About You and Why?

We collect information about you directly from you and from third parties, as well as automatically through your use of our Site or Services.

Information We Collect Directly From You. We collect information from you when you request information from us, full out an online questionnaire or survey, sign-up for a subscription, place an order, apply for employment with us, or otherwise contact us. The type of information that we collect from you depends on your particular interaction with our Site and Services and may include you: name, business or personal contact information (postal address, billing address, telephone number, fax number, e-mail address), job title, payment information (including financial account numbers or credit or debit card numbers), purchase history, and your job application submission. Please note that not all features are available on all of our websites.

Information We Collect Automatically. We may automatically collect the following information about all users of our Site or Services through cookies, web beacons, and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our Services; and the referring URL, or the webpage that led you to our Site, and the following: access time, browser type, device ID, domain name, IP address, page views and referring URL. Job Applicants. If you choose to apply for an option position through our Site, we will request your name, contact information, national identifying information, job history and resume. The Company uses job applicant data for purposes of processing your application, recruitment and selection process, such as assessing your suitability for a job, performing background checks (as permitted by law), other human resources management purposes, and as required or permitted by law. We may share the information that you submit in the following circumstances and with the following entities: among our affiliated entities and third party service providers, both of which may be located outside of your home jurisdiction and may not have the same level of data privacy protection as your home country, with law enforcement, and as otherwise required or permitted by law to protect our rights and interests, in response to a valid legal process, or to protect the rights and interests of our employees and other persons. Should you become an employee of Bonpastry, your personal data will be treated pursuant to the Company’s human resources policies, which are made available to employees upon hire. Please note: if you apply for a position through the Site, we also collect the information about you automatically as described above.

How We Use Your Information

For non-job applicants, we use your information, including your personal information, for the following purposes:

  • To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries and for other service purposes.
  • To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Site or our Services.
  • For marketing and promotional purposes.   • Where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or violations of our Terms of Use or this Policy.
  • We use personal data for marketing and promotional purposes, including through email or equivalent electronic means. For example, we may use personal data, such as an email address, to send news and newsletters, special offers and promotions, or to otherwise contact customers and vendors about products, services or information we think may interest them. We also may use personal data to assist us in advertising our services on third-party websites.

How We Share Your Information

We may share your information, including personal information, as follows: We may disclose personal data as follows (in some jurisdictions, data privacy laws may require us to obtain consent before we do so):

  • Users. Your user name and any information that you post to our Site, including, without limitation, reviews, comments, and text will be available to, and searchable by, all users of the Site and Services.
  • Affiliates and Subsidiaries. We may disclose the information we collect from you to our affiliates or subsidiaries.
  • Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions on our behalf. For example, personal data regarding job applicants is processed by third party providers of human resources technologies and services.
  • Other Non-Affiliated Third Parties. We may disclose personal data to non-affiliated third parties, such as promotional partners and others with whom we have marketing or other relationships for their own marketing purposes. Those third parties may use personal data for marketing purposes, such as to market products and services that they believe would be of interest to our customers and vendors. We also may combine your personal data with other information that we obtain from third parties. This information may help us to determine what advertisements to direct to you, to place on our Site, and where to advertise our services. We may also disclose personal data to respond to your choices, such as to inform a third party that you have withdrawn consent to receiving marketing from that third party. For the avoidance of doubt, job applicant information will not be used for marketing purposes.

International Transfers and Offshore Storage of Personal Data

We may use, disclose, process, transfer or store personal data to our affiliates outside the country in which it was collected, such as to the United States and other countries, which may not guarantee the same level of protection for personal data as the country in which you reside.

Our Use of Cookies and Other Tracking Mechanisms

We and our third party service providers use cookies and other tracking mechanisms to track information about your use of our Site or Services. We may combine this information with other personal information we collect from you (and our third party service providers may do so on our behalf).

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the Third Party Ad Network section.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Service. There are two types of cookies: session and persistent cookies.

  • Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Site. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site.

Visitors to our Site who disable cookies will be able to browse certain areas of the Site, but some features may not function.

Local Storage Objects. We may use Flash Local Storage Objects (“Flash LSOs”) to store your Site preferences and to personalize your visit. Flash LSOs are different from browser cookies because of the amount and type of data stored. Typically, you cannot control, delete, or disable the acceptance of Flash LSOs through your web browser. Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We and our third party service providers also use clear GIFs in HTML e-mails, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Third Party Analytics. We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site and, to the extent permitted, our Application. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. Third-Party Ad Networks

We use third parties such as network advertisers to display advertisements on our Sites, to assist us in displaying advertisements on third party websites, and to evaluate the success of our advertising campaigns. Network advertisers are third parties that display advertisements based on your visits to our Site as well as other websites. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested. Third party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. We are not responsible for the information practices of such third party websites.

Security of My Personal Information

We have implemented precautions designed to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Access to and Control over Personal Data

You provide your personal data to us voluntarily. In certain jurisdictions, and as permitted by applicable law, you have the right to access personal data that Bonpastry holds about you; to request that we stop using or disclosing your personal data; to request that we update, amend or delete your personal data; and to withdraw any previously given consent with regard to your personal data at any time using the contact information below. The Company will respond to a data access requests in accordance with applicable law; please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time.

Special Information for California Consumers

California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response.
